Erin Durba is a Senior Counsel in the Commercial Litigation practice group. Erin has extensive experience litigating complex commercial disputes in federal and state courts, arbitration and mediation. She has led litigation and trial teams at all stages of the litigation process, from pre-complaint investigations, analysis and client counseling, through discovery, motion practice, trial and appeals. Her experience encompasses a wide range of topics, including contracts, insurance coverage, antitrust, consumer protection, employment discrimination, employee compensation, non-compete and trade secrets, business divorce, civil rights, intellectual property, and securities and broker-dealer laws and regulations.
Erin graduated summa cum laude from Loyola College in Maryland in 2001 and received her law degree from Columbia University School of Law in 2005. She spent nine years in the litigation and dispute resolution practice group at a major New York City law firm, where she represented businesses in high-stakes commercial cases. She then spent two years litigating large multidistrict class actions in federal court involving antitrust and consumer protection claims. Erin joined Harrington, Ocko & Monk in 2018.
Representative Matters:
- Won summary judgment dismissing claims in New York State Supreme Court brought by a college professor who alleged age discrimination in connection with the college’s decision not to renew his teaching contract.
- Successfully opposed a motion for class certification in a wage and hour putative class action in New York State Supreme Court, and successfully opposed plaintiff’s counsel’s subsequent motion seeking additional pre-class certification discovery.
- Successfully moved to dismiss false arrest, malicious prosecution and due process claims in federal court arising out of a university’s investigation of an on-campus incident.
- Obtained dismissal, at the pleading stage, of civil rights claim brought against a foster care agency in federal court under 42 U.S.C. §1983. t.
- Obtained pre-hearing dismissal of age discrimination filed by college professor with the New York State Department of Human Rights.
