2013 NEWS…

• Harrington, Ocko & Monk, LLP obtains favorable decision in Peters v. Molloy College of Rockville Center, 2013 WL 5652503 (E.D.N.Y. Oct. 16, 2013). Kevin Harrington and John Rosenthal recently obtained summary judgment on behalf of client Molloy College and several of its employees (the “Defendants”) in a discrimination and retaliation action brought by a former graduate nursing student in Federal District Court in the Eastern District of New York. The graduate student alleged that one of her professors gave her a failing grade in a course based upon her race. The student also alleged that Molloy discriminated and retaliated against her, based on her race and her engagement in a protected activity, by denying her graduation and by not following college protocols regarding grade appeals. Hon. Judge Hurley granted summary judgment to Defendants and dismissed the Federal discrimination and retaliation claims in their entirety. In his decision, the judge held that Defendants had demonstrated that the student received a failing grade due to possible plagiarism on her final project, the student failed to follow college required grade appeal procedures, and the Plaintiff student did not present sufficient evidence to rebut these facts. The Plaintiff student did not appeal the court’s decision.

• John Rosenthal will be speaking at the California Cyber Law Committee monthly meeting via conference call, on Tuesday, December 17, 2013 at 8:00 p.m. EST regarding updates on nexus taxation laws in various states.

• Glenn A. Monk, Statewide Co-Chair, Torts, Insurance & Compensation Law Section of the New York State Bar Association’s sponsored program “Law School for Insurance Professionals,” will also be Program Chair of the New York City Program on October 4, 2013.

• I. Paul Howansky will be speaking at the New York State Bar Association’s sponsored program “Law School for Insurance Professionals” on the topic of Declaratory Judgment Actions on October 4, 2013.
